In the UK, there is a formal process that must be followed to initiate divorce proceedings. If you are unsure what to do, you should seek legal advice from a solicitor. The procedure of serving a Divorce Petition correctly is to ensure that the Court has sufficient evidence that your spouse has received the divorce papers. If the respondent does not respond and refuses to acknowledge that they’ve received these documents, the next options are usually for a Process Server or Court Bailiff to try to personally serve.

Upon successful service of the respondent, we then issue you a Statement of Service which entails the time, date, and location of service. If we are unsuccessful, we then send an attempted service statement. If it’s not possible for us to serve the respondent, it is possible to demonstrate that we have made sufficient attempts to serve the respondent to the court through the attempted statement of service. Depending on the exact circumstances, this can be used as evidence to apply for a deed service, to dispense service altogether, or to make an application for substitute service, which is seen as service by an alternative means.
